General conditions

These Home Climate OÜ, registry code 11424269, (hereinafter referred to as Home Climate OÜ) terms and conditions of purchase and sale (hereinafter referred to as the terms and conditions) apply to all persons (hereinafter referred to as the Buyer) who purchase goods through the Home Climate OÜ e-shop (hereinafter referred to as the e-shop) or order services. Pakendikeskus has the right to change or supplement the conditions and price list without notice. The aforementioned changes and additions will be notified on the website homeclimate.ee and will take effect from the moment of publication.

All personal data of the Buyer that becomes known in the course of visiting the Home Climate OÜ e-store and making purchases are confidential. By entering data in the e-shop, the Buyer gives the right to collect and process the Buyer’s personal data (company name, name, contact phone number, address for delivery and/or registration of the goods, e-mail address, etc.) and to transmit the Buyer’s personal data to the person performing the delivery of the goods for the delivery of the goods. An encrypted data communication channel with banks ensures the security of the Buyer’s personal data and bank details, Home Climate OÜ does not have access to them.

Home Climate OÜ has the right to use the Buyer’s delivery and/or registration address for advertising and other information about its products and services. In addition to these terms and conditions, the legal relationships arising from the purchase of products from the e-store are governed by the Law of Obligations Act (hereinafter VÕS), the Consumer Protection Act (hereinafter TKS) and other legislation in force in the Republic of Estonia.

PROCESS OF FORMING AN ORDER FROM THE E-STORE

The buyer adds the desired products to the shopping cart. To complete the order, the buyer presses the «Formulate order» button on the product page or the information button displaying the contents of the shopping cart. The buyer checks the products and quantities added to the shopping cart. If the content of the shopping cart is confirmed to be correct, the Buyer clicks on the «Format order» button. The buyer makes a choice between two types of e-store users. Creating an e-shop account is not mandatory, e-shop orders can be placed both registered and unregistered. Submitting e-store orders while registered and logged in may provide discounts and/or negotiated prices for business customers according to campaigns. The Buyer fills in the contact data and/or delivery data columns carefully, because the quick and trouble-free delivery of the goods ordered by the Buyer and the subsequent settlement of claims depend on the accuracy and correctness of the information provided.

The buyer makes a choice regarding the method of delivery of the goods. Home Climate OÜ offers the following options for delivering the goods: – The buyer picks up the goods himself at the e-store offices in Tallinn; – The goods are delivered to the buyer by courier to the desired address; -The buyer orders the goods at SmartPOSTI or Omniva parcel machine. The buyer chooses the method of payment for the goods. Home Climate OÜ offers the following options for paying for goods: – directly through internet bank links (Swedbank, SEB, Nordea, LHV banks and Mastercard and Visa credit cards); -payment by invoice, which is divided into 3 days for payment in advance or for payment to contracted companies on the basis of an invoice, according to the specified payment deadline. Orders paid in advance by the Buyer in the e-store are processed from the moment of receipt on working days from 08:30 to 16:30. Depending on the volume of work, orders confirmed after 15:00 may be processed the following business day. Also applies to the „I’ll pick it up” delivery option. Orders confirmed by the Buyer of the contractual company in the e-shop are processed on working days from 08:30 to 16:30. Placing an order does not mean an automatic reservation of the goods. After placing the order, the Seller’s representative will contact the Buyer as soon as possible to confirm the order and agree on the details. If it turns out to be impossible to fulfill the order, the Seller’s representative has the right to offer the Buyer the opportunity to choose an equivalent product. If the Buyer does not want a replacement product, the order is canceled and if it has already been paid for, the Seller returns the money to the Buyer’s account within 14 working days from which the transfer was received. Conclusion of the contract The purchase-sale contract between the Buyer and the Seller is deemed to have been concluded from the moment when the Buyer has paid the first deposit for the goods to the Seller’s bank account or in cash to the Seller’s authorized representative. Canceling the order The buyer has the right to cancel the erroneous order by notifying the Seller via e-mail, telephone or other channels. The order is automatically canceled if the Buyer has not made the first payment within two working days after the payment deadline.
